Welcome to Derwaza Mall, operated by Tamm Store General Trading Company. These Terms and Conditions govern your use of our website and the purchase of products and services offered through it. By accessing the website or placing an order, you agree to comply with these Terms and Conditions.
1. Website and Account Use
Customers must provide accurate, current, and complete information when creating an account or placing an order, including their name, telephone number, email address, and delivery address.
Customers are responsible for protecting their account credentials and must notify us immediately if they suspect any unauthorized use of their account.
Customers must be at least 18 years old or use the website under the supervision of a parent or legal guardian.
The website must not be used for unlawful, fraudulent, or harmful activities.
2. Products and Prices
We make reasonable efforts to ensure that product descriptions, images, prices, specifications, and availability information are accurate. However, unintentional errors or manufacturer changes may occasionally occur.
Product prices may be displayed in a currency based on the customer’s geographical location or the currency selected from the options available on the website. The final price, applicable currency, delivery charges, and any additional fees will be shown before the order is confirmed.
The customer’s bank or payment provider may apply currency conversion rates or additional fees. Derwaza Mall is not responsible for such charges.
Product colors or appearance may vary slightly from the images displayed due to screen settings, lighting, or manufacturer updates.
If a material pricing, description, or specification error is discovered, Derwaza Mall may contact the customer to correct the order or cancel it and refund any amount already paid.
3. Placing and Accepting Orders
Submitting an order through the website constitutes an offer to purchase the selected products. An order is not finally accepted until:
The order information has been verified.
Payment has been confirmed, where applicable.
Product availability has been confirmed.
An order acceptance confirmation has been sent to the customer.
An initial message confirming receipt of the order does not necessarily constitute final acceptance.
Derwaza Mall may cancel an order before dispatch if:
The product is unavailable.
A pricing or product information error has occurred.
The customer’s information or payment cannot be verified.
Fraudulent or unlawful activity is suspected.
The order cannot be fulfilled for reasons beyond our reasonable control.
If a paid order is cancelled, the payment will be returned in accordance with the refund conditions below.
4. Paying for Your Order
Customers can pay using any of the options shown on the checkout page. Available options may include KNET, Visa, Mastercard, Apple Pay, Google Pay, and other supported services.
All financial transactions are securely processed by authorized financial service providers. Derwaza Mall does not store complete bank card details.
The customer’s bank or financial service provider is responsible for approving the transaction.
Customers must provide accurate card or account information and ensure that sufficient funds or credit are available.
Eligible orders may be paid in four instalments through Taly. Approval, eligibility, and the instalment schedule are subject to Taly’s terms. Derwaza Mall cannot guarantee approval for instalment payments.
5. Delivery
Orders are delivered to supported areas within the State of Kuwait, even when the website is accessed or the order is placed from outside Kuwait.
Delivery charges and estimated delivery times are shown before the order is confirmed. They may vary depending on the delivery area, product type, size, availability, and delivery conditions.
Customers are responsible for providing a complete and accurate delivery address and a telephone number through which they can be contacted. Incomplete information or an inability to contact the customer may result in a delay or return of the order.
An order may be delivered to the customer or to an adult at the delivery address who is authorized to receive it.
Customers should inspect the shipment upon receipt and notify us as soon as possible of any visible damage, missing item, or incorrect product.
Delivery times are estimates and may be affected by circumstances beyond Derwaza Mall’s reasonable control, including weather conditions, traffic, or delivery service interruptions.
6. Order Cancellation
Customers may request cancellation before an order has been dispatched by contacting us.
If the order has already been dispatched, the request will be subject to the return and refund conditions.
Delivery charges may not be refundable once the delivery service has been performed unless the cancellation or return is caused by an error by Derwaza Mall, a defective or non-conforming product, or otherwise required by law.
We cannot guarantee that an order can be stopped after preparation has begun or after it has been transferred to the delivery provider.
7. Returns and Exchanges
Customers may request a return or exchange within fourteen (14) days from the delivery date, subject to the applicable laws of the State of Kuwait and the following conditions:
Proof of purchase, an order number, or another purchase record must be provided.
The product must be in its original and resalable condition.
The product must be unused and include its original packaging and accessories where required by the nature of the product.
The product must not have been damaged, misused, or neglected by the customer.
Returned products will be inspected before final approval of the return or exchange.
Certain products may be excluded from return for health, hygiene, or product-specific reasons, including:
Opened or used personal care or beauty products.
Opened food or consumable products.
Activated digital products, software, or cards.
Products manufactured or modified specifically for the customer.
Other products that may legally be excluded.
These exclusions do not apply when a product is defective, does not conform to its description or specifications, or when an incorrect product has been supplied.
Purchasing a product during a promotion or discount does not remove the customer’s statutory rights.
8. Refunds
After the returned product has been inspected and the return has been approved, the refund will be issued through the original payment method used for the order.
The time required for the refunded amount to appear is subject to the procedures and policies of the payment gateway, bank, or issuer of the payment method and may vary between payment methods.
If a refund through the original payment method is technically unavailable, we will contact the customer to arrange an appropriate alternative in accordance with applicable law.
Delivery charges are not refundable after the delivery service has been performed unless the return is caused by a defective, incorrect, or non-conforming product, an error by Derwaza Mall, or otherwise required by law.
Derwaza Mall is not responsible for delays caused by the bank or payment provider after the refund request has been issued by us.
9. Damaged, Defective, or Incorrect Products
If a product arrives damaged, defective, or different from the product ordered, the customer must contact us and provide the order number and photographs or other information showing the issue.
After verification, an appropriate remedy will be provided, which may include:
Repairing the product.
Replacing the product.
Refunding the product’s value.
The appropriate remedy will depend on the nature of the issue, the applicable warranty conditions, and applicable law.
This does not include damage caused by misuse, negligence, accidents, improper installation, or unauthorized repair.
10. Warranty
Products are covered by the relevant agent’s or manufacturer’s warranty according to the period and conditions stated on the product page or in the warranty documentation supplied with the product.
A purchase invoice, product serial number, accessories, or warranty documentation may be required for warranty service.
Inspection, repair, or replacement is subject to the procedures of the relevant agent or manufacturer.
Warranty coverage generally excludes damage caused by:
Misuse or negligence.
Breakage, dropping, or accidents.
Exposure to liquids or moisture.
Modification or repair by an unauthorized party.
Use contrary to the manufacturer’s instructions.
This section does not limit the customer’s rights under the applicable laws of the State of Kuwait.
11. Promotions, Discounts, and Coupons
Promotions and coupons are subject to their stated validity periods and conditions.
Coupons generally cannot be exchanged for cash or used more than once unless otherwise stated.
Certain promotions may be limited to specific products, categories, quantities, or customers.
Derwaza Mall may amend or discontinue a promotion in cases of technical error, fraud, or misuse without affecting accepted orders or customers’ statutory rights.
12. Product Availability
Stock information is based on the data available to us and may change before an order is confirmed.
A product may become unavailable after an order has been placed. In such cases, we will contact the customer to offer a suitable alternative or cancel the unavailable product and refund its value.
A product will not be replaced with another product without the customer’s approval.
13. Limitation of Liability
Derwaza Mall makes reasonable efforts to maintain the accuracy and availability of the website but cannot guarantee that it will remain permanently uninterrupted or error-free.
Derwaza Mall is not responsible for delays or interruptions caused by circumstances beyond its reasonable control, including interruptions involving internet services, payment gateways, delivery providers, or emergencies.
Derwaza Mall is not responsible for losses caused by inaccurate information provided by the customer.
Nothing in these Terms and Conditions excludes or limits consumer rights that cannot legally be excluded under the laws of the State of Kuwait.
14. Intellectual Property
Content owned by Derwaza Mall, including its name, logo, text, designs, and images, is protected under applicable laws.
Such content may not be copied, republished, distributed, or commercially used without prior written permission.
Third-party trademarks, images, and content remain the property of their respective owners.
15. Privacy and Personal Information
Personal information is collected, used, and protected in accordance with the Privacy Policy published on the website.
By using the website, customers acknowledge the Privacy Policy and agree to the processing of their information as reasonably necessary to fulfil orders, provide services, and communicate with them.
16. External Websites and Services
The website may contain links to or services provided by third parties, including payment gateways, instalment providers, and delivery providers.
These services are subject to the terms and policies of their respective providers. Derwaza Mall is not responsible for external website content or services outside its reasonable control.
17. Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of the State of Kuwait.
The competent authorities and courts of Kuwait shall have jurisdiction over disputes, subject to applicable consumer rights.
If any provision is found to be invalid or conflicts with a mandatory legal requirement, the applicable legal requirement will prevail, and the remaining provisions will continue in effect.
18. Changes to These Terms
Derwaza Mall may update these Terms and Conditions when necessary. Updates become effective from the date they are published on the website.
Updates will not affect orders accepted before the update date unless otherwise required by law.
